1. Overview

These Terms & Conditions ("Terms") govern your use of the Costie software platform ("the Platform"). By creating an account, accessing, or using the Platform, you agree to be bound by these Terms.

If you do not agree to these Terms, you must not use the Platform.

2. Amendments to These Terms

We may update these Terms from time to time. Updated Terms take effect immediately upon posting within the Platform.

We will notify users of material changes by in-app notice or email (where available).

Continued use of the Platform after changes signifies acceptance of the updated Terms.

3. User Eligibility

To use the Platform, you must:

  • Be at least 18 years of age
  • Be legally able to enter into binding agreements
  • Use the Platform only for lawful purposes

4. Services Provided

The Platform provides digital tools for cost management, estimation, reporting, administration, and related commercial services (collectively, "Services"). Service features may evolve and be updated over time.

We may offer a free tier or trial period with limited features. Access to additional features may require a paid subscription. Feature availability and limitations will be clearly displayed within the Platform.

5. Account Responsibilities

You agree to:

  • Provide accurate information when creating an account
  • Keep login details secure
  • Be responsible for all activity conducted under your account

You must notify us immediately of any unauthorised access.

6. Fees, Billing & Payment

If using a paid plan, you agree to pay all fees as displayed at the time of subscription.

6.1 Refunds & Australian Consumer Law

We comply with Australian Consumer Law, which prohibits blanket "no refund" policies and requires businesses to explain when refunds or replacements apply.

Refunds are provided where required under the ACL, including where the service:

  • Is not provided with due care and skill
  • Is not fit for the purpose we represent
  • Is not delivered within a reasonable time

For change-of-mind cancellations, refunds may not be offered unless stated otherwise.

7. User Data & Privacy

7.1 Data Ownership

You retain ownership of all data you input into the Platform.

7.2 Licence to Use Data

You grant us a limited licence to store, process, and display your data solely to provide the Services.

7.3 Privacy

We handle data in accordance with our Privacy Policy.

8. Intellectual Property

We retain all intellectual property rights in the Platform, its code, design, tools, generated templates, and associated materials.

You must not:

  • Copy, modify, or reverse-engineer the Platform
  • Reproduce platform content except as permitted for your business use

8.1 AI-Generated Content

The Platform may include features that use artificial intelligence to generate content, such as project schedules, estimates, or suggestions.

  • AI outputs are provided as suggestions only and do not constitute professional advice
  • You are responsible for reviewing and accepting any AI-generated content before use
  • Once generated and saved to your account, AI-generated content becomes your property

9. Acceptable Use

You agree not to use the Platform to:

  • Engage in unlawful activities
  • Upload harmful or malicious content
  • Circumvent security or technical controls
  • Interfere with system performance or other users
  • Misuse or manipulate data to breach laws or contract obligations

Such conduct may result in immediate suspension or termination.

10. Service Availability & Support

We strive to provide high availability and reliable service. However, we do not guarantee uninterrupted access.

Support is provided as published or agreed as part of your subscription plan.

11. Limitation of Liability

To the maximum extent permitted by law:

  • Our liability is capped at the total fees paid by you in the preceding 12 months.
  • We exclude all responsibility for indirect or consequential loss, including lost profits, business interruption, or data corruption.

Nothing in these Terms limits rights or guarantees that cannot be excluded under Australian Consumer Law.

12. Termination

We may suspend or terminate your access if you breach these Terms or if required for operational or legal reasons.

You may cancel your subscription at any time. Your access will continue until the end of the current billing period unless otherwise stated.

Upon termination, you will have 30 days to export your data unless prohibited by law or court order. After this period, your data may be permanently deleted.

13. Dispute Resolution

If a dispute arises, we encourage resolution through the following process:

  1. Informal Resolution: Contact us directly to attempt to resolve the matter within 14 days.
  2. Mediation: If informal resolution fails, both parties agree to attempt mediation with a mutually agreed mediator, with costs shared equally.
  3. Legal Proceedings: As a last resort, disputes may be brought before the courts of Queensland, Australia.

14. Governing Law

These Terms are governed by the laws of Queensland, Australia. You agree to submit to the exclusive jurisdiction of the courts of Queensland for any disputes arising from these Terms.
